All road users owe a duty to take reasonable care for the safety of other road users and their passengers, but unfortunately accidents on the road are very common, with most people being involved in such an accident on at least one occasion during their lifetime, whether it is as a driver, passenger, cyclist, motorcyclist or pedestrian.

If you have been injured as a result of an accident on the road, then you may have a claim for compensation even if you feel that you were partly at fault.  Indeed, many road accident cases involve blame lying partly with one driver and partly with another, but that does not prevent you from bringing a claim for compensation to mirror the extent to which the other driver was at fault.  It simply means that your compensation payment may be reduced to reflect your share of the blame.

Vehicles are required by law to be insured to cover the payment of compensation claims.  However, you may still be able to bring a claim even if the person at fault does not have valid insurance, or where that person leaves the scene in a “hit and run” accident.  In these types of cases, there is an organisation called the Motor Insurers’ Bureau that will pay compensation to people who have been injured by an uninsured or untraced driver.

Passengers who are injured in an accident are usually treated as innocent victims and will normally have a claim either against their own driver or another driver involved, depending upon who was to blame.  When we speak of passengers, we most commonly think of passengers in a car, but the rules apply equally to passengers on buses who may have been injured by the careless driving of the bus driver, passengers in taxis and pillion passengers on motorcycles.  You should not be put off bringing a claim as a passenger simply because the driver at fault is a friend or family member as it will be the insurance company that will pay for the claim.
